1. Agreement to Terms
By accessing or using Mochivia (the “Service”), operated by Bleau Labs LLC (“Bleau Labs,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. These Terms govern your use of the Mochivia platform, including our website, mobile applications, and related services.
2. Eligibility & Accounts
You must be at least 13 years old to use our Service. Users under 18 must have parental or guardian consent.
You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate, current information when creating your account and keep it updated.
3. Description of the Service
Mochivia provides an AI-powered learning platform that creates personalized educational content, tracks learning progress, and adapts to your individual learning style and goals. Features include AI-generated lessons, personalized learning paths, progress tracking, interactive quizzes, and adaptive content delivery.
4. AI-Generated Content
Content generated by the Service may be produced using artificial intelligence systems and may contain inaccuracies, biases, or outdated information. We do not guarantee the accuracy, completeness, or usefulness of any content generated through the Service. The Service is provided for educational purposes and should not be relied upon as professional, financial, medical, or legal advice.
Always verify important information from authoritative sources before making decisions based on AI-generated content.
5. Payments & Subscriptions
We offer subscription plans with different features and usage limits. Pricing is clearly displayed at the time of purchase. Free trial periods may be offered and will automatically convert to a paid subscription unless cancelled before the trial ends.
Web Purchases
Subscriptions purchased through our website are processed by Stripe. You can cancel anytime through your account settings. Refunds for web purchases are handled on a case-by-case basis — contact us within 30 days of purchase.
iOS Purchases
Subscriptions purchased through the iOS app are processed by Apple and managed through your Apple ID. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. You can manage and cancel subscriptions in your Account Settings on the App Store. Refunds for iOS purchases are handled by Apple.
6. Apple Application License
The Mochivia iOS application is licensed, not sold, to you. Your use of the app is subject to these Terms and the Usage Rules established by Apple Inc. (“Apple”) in the App Store Terms of Service.
Bleau Labs LLC is solely responsible for providing maintenance and support for the app. Apple has no obligation to provide any maintenance or support services with respect to the app.
Bleau Labs LLC, not Apple, is responsible for addressing any claims relating to the app, including but not limited to product liability claims, any claim that the app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms as they relate to the iOS application, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
7. Acceptable Use
You agree to use our Service responsibly. You may not:
- Violate any applicable laws or regulations
- Attempt to hack, reverse engineer, or disrupt our systems
- Share inappropriate, harmful, or illegal content
- Impersonate others or create fake accounts
- Abuse our AI systems or attempt to manipulate responses
- Scrape data or commercially exploit our content without permission
8. Intellectual Property
Ownership of the Service
The Service and its original content, features, and functionality are owned by Bleau Labs LLC or its licensors and are protected by intellectual property laws.
User Input
You may provide prompts, questions, or other information to the Service (“Input”). You retain ownership of your Input. You are responsible for ensuring your Input does not infringe on the rights of others.
AI-Generated Output
Subject to these Terms, Bleau Labs grants you a non-exclusive license to use AI-generated content produced through the Service for any lawful purpose. You may not redistribute, resell, or commercially exploit the Service itself.
Third-Party Content
The Service may display images, media, or other materials sourced from third-party websites through search or indexing services. Such materials remain the property of their respective owners and are provided for informational and reference purposes only. Mochivia does not host or control these materials and provides them solely through links or thumbnails referencing the original sources. Mochivia does not claim ownership of third-party content.
Copyright Complaints
If you believe that content displayed through the Service infringes your copyright, please contact us at legal@bleaulabs.com and we will promptly investigate and remove the material where appropriate.
9. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
10. Account Termination
You can delete your account at any time through the app settings or by contacting us. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.
We may suspend or terminate accounts that violate these Terms or for other legitimate reasons, with notice where practicable.
11. Disclaimers & Limitation of Liability
We provide our Service “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee uninterrupted, error-free, or secure operation of the Service. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.
Bleau Labs shall not be liable for indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.
We may integrate with third-party services. We are not responsible for their availability, accuracy, or policies.
12. Indemnification
You agree to indemnify and hold harmless Bleau Labs LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.
13. Dispute Resolution
Informal Resolution. Before filing a formal dispute, you agree to contact us at legal@bleaulabs.com and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration. Any dispute arising from these Terms that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will be conducted on an individual basis in Maricopa County, Arizona, unless the parties agree otherwise.
Class Action Waiver. You agree that disputes will be resolved only on an individual basis and not in any class, consolidated, or representative action. If this waiver is found unenforceable, then the entirety of this arbitration provision shall be void.
Small Claims Exception. Either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
Opt-Out. You may opt out of this arbitration provision within 30 days of first accepting these Terms by emailing legal@bleaulabs.com with the subject line “Arbitration Opt-Out.”
14. Legal & Governance
Governing Law. These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
Exclusive Venue. For any disputes not subject to binding arbitration under Section 13, you agree that the exclusive jurisdiction and venue shall be the state and federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.
Changes to Terms. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the revised Terms. We will notify you of material changes via email or in-app notification.
Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Entire Agreement. These Terms constitute the entire agreement between you and Bleau Labs LLC regarding the Service and supersede all prior agreements and understandings.
